1. About DiveLink
DiveLink is a trading name of Dylan Joseph Royle, a sole trader operating in the United Kingdom (“DiveLink”, “we”, “us”, “our”).
DiveLink operates an online platform designed to connect commercial divers and diving operators for professional opportunities.
DiveLink is not a recruitment agency, employer, contractor, or payment intermediary. We do not employ divers, contract operators, or broker employment relationships.
2. Acceptance of Terms
By creating an account or using the Platform, you agree to be bound by these Terms and Conditions.
If you do not agree, you must not use the Platform.
3. Eligibility
- You must be at least 18 years old to use the Platform.
- By registering, you confirm that:
- You are legally capable of entering into binding agreements.
- Any information you provide is accurate and truthful.
4. Nature of the Platform
DiveLink is a job marketing and networking platform only.
DiveLink:
- Does not verify qualifications or certifications.
- Does not guarantee employment.
- Does not assess competence, safety standards, or regulatory compliance.
- Does not conduct background checks.
- Does not supervise work undertaken between users.
All verification of qualifications, experience, insurance, and regulatory compliance is the sole responsibility of the users involved.
Any agreement formed between users is strictly between those users. DiveLink is not a party to that agreement.
5. Certifications and Uploaded Content
- Divers may upload certifications and related documentation.
- DiveLink does not independently verify the authenticity, validity, or currency of any uploaded document.
- Operators must independently verify all qualifications before engaging a diver.
- Users are solely responsible for ensuring the accuracy and legality of any content they upload.
6. User Conduct
Users agree not to:
- Provide false or misleading information.
- Upload fraudulent or altered certifications.
- Engage in harassment, abuse, or unlawful conduct.
- Use the Platform for illegal or unauthorised purposes.
- Attempt to interfere with the operation or security of the Platform.
DiveLink reserves the right to suspend or permanently terminate accounts at its sole discretion.
7. Messaging and Communications
- The Platform includes messaging functionality.
- DiveLink does not monitor communications routinely but reserves the right to review content where misuse is reported.
- DiveLink may remove content or suspend accounts if communications breach these Terms or applicable law.
8. Open Beta Status
- DiveLink is currently provided as a free open beta service.
- The Platform may contain errors, bugs, or incomplete features.
- We may modify, suspend, or discontinue any part of the Platform at any time without notice.
9. No Fees (Beta Period)
- The Platform is currently free to use.
- DiveLink reserves the right to introduce fees in the future with prior notice.
10. Limitation of Liability
DiveLink provides the Platform on an “as is” and “as available” basis.
To the fullest extent permitted by UK law, DiveLink shall not be liable for:
- Injury or death arising from diving activities.
- Loss of income or employment.
- Contract disputes between users.
- Fraud, misrepresentation, or misconduct by users.
- Regulatory breaches committed by users.
- Any indirect or consequential loss.
Nothing in these Terms excludes liability that cannot legally be excluded under UK law.
11. Indemnity
Users agree to indemnify and hold harmless DiveLink from any claims, losses, liabilities, or expenses arising from:
- Their use of the Platform.
- Their breach of these Terms.
- Any agreement entered into with another user.
12. Intellectual Property
- All Platform content, branding, and design elements are owned by DiveLink.
- Users retain ownership of content they upload but grant DiveLink a non-exclusive licence to display that content on the Platform.
13. Account Termination
- Users may delete their accounts at any time.
- DiveLink may suspend or terminate accounts without notice where these Terms are breached.
14. Data Protection
- Personal data is processed in accordance with our Privacy Policy.
- Users are responsible for ensuring they comply with applicable data protection laws when using information obtained through the Platform.
15. Governing Law
- These Terms are governed by the laws of England and Wales.
- Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
